Little Lunches Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Your use of the website and the services provided through the website is subject to these terms and conditions. By using the website you represent that you have read and understood the Terms and conditions and agree to be bound by them.

These terms and conditions govern your use of this website; by using this website, you accept these terms and conditions in full.   If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website.

While Little Lunches endeavours to ensure that the information provided on the website is free from error, Little Lunches does not warrant its accuracy, adequacy or completeness, and Little Lunches shall not be responsible or liable for any error in, or omission from, the information provided on the website.

We reserve the right to make changes to the information provided on the website at any time and without notice.

OUR PRODUCTS

We offer a variety of products within the lunches/afternoon tea, including but not limited to fruit, vegetables, hummus, yoghurt, sandwiches, wraps, sushi smash, Buddha bowls, & healthy treats.  We cannot guarantee the contents of our products in advance as we use fresh ingredients and so the contents of the products may depend on the availability of fresh produce/items from suppliers, fruit & vegetable options are seasonal.  Menu options will change regularly and we reserve the right to change the menu options at any time.

None of our products contain nuts however some menu items may have been prepared in kitchens or on bench tops where nuts have been present & therefore may contain traces of nuts. Gluten-free products are made with no gluten containing ingredients, but may contain traces of gluten.  Dairy-friendly products are made with no dairy-containing ingredients, but may contain traces of dairy. Please consider this before ordering. It is up to you, the consumer or parent / legal guardian to check the full ingredient list under ‘More Information’ before ordering.

ORDERS:

Orders must be made by 9am the day of delivery & some orders including sushi smash, Buddha bowls & Rice paper rolls need to be made by the night before the delivery date.  Orders can be made up to one month in advance.

Each order must include an address to which the order is to be delivered. Little Lunches delivers only to certain suburbs of, schools and businesses in Christchurch.

If you or the intended recipient of a lunch are unwell on a scheduled day for delivery of a lunch or if you or the intended recipient will otherwise not be present to take delivery of the lunch and you have not postponed your lunch by 8am the day of delivery, you will remain liable for the cost of that lunch.

DELIVERY

We will always aim to deliver your order by the times specified however, to the extent permitted by law, we will not be liable for failure to deliver on a timely basis.

If we consider that your lunch is likely to be significantly delayed, we will contact you to arrange an alternative delivery timeframe. If no alternative timeframe can be agreed, you may reject that lunch order and we will credit you with the cost of it. We may, at our discretion, credit your credit card.

Deliveries will not be made on weekends, public holidays or schools holidays.

Deliveries cannot be made to buildings with restricted access or security requirements.

We may commission third parties to make deliveries.

If you do not provide us with the information requested by us, we may be unable to process your orders and provide the delivery service to you.

ACCOUNTS

We reserve the right to refuse an application to open an account, for any reason whatsoever, or to suspend your ability to place orders through the website, or to cancel an account for any reason.

You must keep your account login details secure at all times and do not give your login details to any other person.  You will be liable for all orders placed through your account.

PAYMENT / COSTS

All orders need to be paid by credit card prior to the lunch delivery.  

All prices are listed on our website are in New Zealand dollars.  All prices are inclusive of GST. Little Lunches reserves the right to change prices at any time, we will notify you of a price increase by e-mail at least eight days before the delivery date for the affected order.  There is no additional charge for delivery.

If we invoice an incorrect amount to your credit card, we reserve the right to repay you by refunding your registered credit card or to make an additional charge to your credit card to recover any undercharge. You authorise us to make such additional charge.

If orders are not paid for in full or a customer's bank declines payment on a customer's bank card and as a result money is owing to Little Lunches, then Little Lunches reserves the right to suspend the customer's ability to place further orders on the website until such time as the outstanding balance has been paid in full.

You are liable for all costs associated with debt collection where you default in payment for any order.

Once full payment has been made it will not be refunded if you cancel your order, however you can postpone your orders to another date.  You must do this by 8am the day of delivery by emailing queries@littlelunches.co.nz

PERSONAL INFORMATION

By using the website you authorise us to collect, keep and use your personal information in the following ways:

*Processing your account application.

*Providing you with personalised features of the Website.

*Fulfilling your orders and communicating with you in respect of your orders, including by text, telephone or email.

*Sending you notifications of offers, new products or services or other promotional materials.

*Enforcing any other legal rights that we may have against you.

We will not release your personal information to any third party except where required or permitted to by law, where you have authorised us to do so or where disclosure is connected to the purpose for which the information was collected.

Any personal information supplied by you may be retained by Little Lunches until such time as you request that the information be removed.

You have statutory rights under the Consumer Guarantees Act (CGA) and Fair Trading Act (FTA) to recover compensation for consequential loss arising from a breach of the CGA or FTA, these rights cannot be excluded or limited in any way. Subject to the CGA and FTA Little Lunches shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever arising from or in relation to your use of, or inability to use, the website, or the delivery or failure to deliver any products.

COMPLAINTS

We will make every effort to ensure that we make our products from fresh, quality ingredients and deliver them in accordance with these Terms. If you have any complaints about our products or the standard of our service, please contact us via our contact us link on our website or email queries@littlelunches.co.nz

If we agree that a product was delivered to you in a damaged or spoiled condition, we may credit you with the value of that product.  We will refund you by either crediting your credit card or alternatively crediting your account balance in your online account.  If you choose to reject an incorrectly delivered lunch order Little Lunches reserves the right to collect the incorrectly delivered lunch order from you. If you are unable, or refuse, to deliver up the lunch order when requested, or deliver the lunch order in a different state, for example, with some products missing or consumed / partially consumed than the state in which it was delivered to you, Little Lunches reserves the right to charge you for that lunch order.

LIABILITY & INDEMNITY

Notwithstanding any other term, you agree to indemnify Little Lunches against all liabilities, losses, claims and expenses suffered or incurred by you, and all claims and demands made against Little Lunches, arising directly or indirectly out of your use of the website, in breach of these terms and conditions.

TERMS AND CONDITIONS

Occasionally we may vary these terms and conditions without notice. Please check these terms and conditions periodically for changes. Your continued use of the website after the terms and conditions have been changed indicates your acceptance of those changes.

Little Lunches reserves the right to make improvements or changes to these Terms and Conditions at any time (including without limitation the correction of errors, omissions, inaccuracies or ambiguities and to meet legal or regulatory requirements). If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.
